Toxicity versus legality

Why is the least toxic substance illegal while the 2nd most toxic substance is legal?

Why is alcohol, which is more lethal than cocaine, not a controlled substance?

Does this make sense to you? Should substances be controlled based on their toxicity or based instead on the historical (or hysterical in the case of marijuana) bias against the substance?
